Applications to discharge planning conditions

LPAs can exercise their discretion about whether to consult HSE about the discharge of a condition, depending on the relevance of the condition(s) to fire safety matters.

If HSE is requested to provide advice in relation to the discharge of a condition on an application for which it was not a statutory consultee (because it was validated before 1 August 2021), HSE will usually return a “no comment” response because it has not had an opportunity to assess the development as a whole.

As a national regulator, HSE is not able to confirm compliance with local plan policies, including London Plan policy requirements related to fire safety in tall residential buildings. This is a matter for the LPA and/or Greater London Authority.
