Applications for a non-material amendment of an existing planning permission

LPAs can exercise their discretion about whether to consult HSE on an application made under Section 96A of the Town and Country Planning Act. HSE cannot advise LPAs on the materiality of a proposed change but can provide advice on the relevance of the change to fire safety matters in developments that include a relevant building, or which are within the curtilage of a relevant building. 

In general, non-material amendments that involve changes to the access arrangements into a building and changes to vehicular access, including changes to landscaping may impact fire safety considerations. Changes to the provision of stairs and lifts and new connections between escape routes and ancillary accommodation may also have an impact on fire safety matters.

There is no requirement to submit a fire statement form with a s96A application.
